1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1.1. The contract between AXOR S.R.L. and the Customer is considered concluded with the acceptance, partial or full, of the order by AXOR S.R.L. Such acceptance is considered tacit unless otherwise communicated to the Customer in any way. By placing an order through the various available methods, the Customer declares to have read and accepted all the information provided during the various stages of the purchase, and to fully accept the general conditions and payment terms.

1.2. If the Customer is a private consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity), upon completing the online purchase process, they will print or save an electronic copy and retain these general conditions of sale, in compliance with Articles 50 et seq. of Legislative Decree 206/05.

1.3. Any right of the Customer to compensation for damages or indemnities, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the total or partial non-acceptance of an order or by any improper use of the purchased products is excluded. All products sold by AXOR S.R.L. are CE marked; therefore, before use, the consumer is obliged to read all the safety measures indicated by the company.

1.4. AXOR S.R.L. reserves the right to cancel an order, upon returning the amount paid by the buyer, due to lack of material availability or for other reasons, even after payment. Any request for compensation for the unavailability of products is also excluded. The buyer will be entitled to a full refund or can claim a credit of equal amount for the choice of alternative products.

1.5. AXOR S.R.L. has all the products for which immediate availability is expressly indicated. All other products, for which the days needed to ship are estimated, are ordered from the respective suppliers upon acceptance of the order. The customer acknowledges that the estimated shipping date is purely indicative and is not binding in the relationship with the customer and third parties; therefore, AXOR S.R.L. is not responsible for delays caused by the supplier’s lack of availability or for any delay not directly attributable to AXOR S.R.L. If, due to force majeure, it is not possible to complete the order even beyond the indicated times, upon customer request, AXOR S.R.L. will provide an immediate refund and order cancellation. In case of payment by bank transfer, the customer undertakes, upon request of AXOR S.R.L., to provide the data necessary to make the payment reversal transfer.

1.6. AXOR S.R.L. is not responsible for damages caused during transport by the carrier, which is solely responsible for the transported goods. Any request for replacement, return, or cancellation for this type of damage can only be made if, upon delivery, any damage to the packaging is notified to the courier with a “conditional signature”. Any product replacement will only be made after all checks have been carried out upon the return of the defective product, within and no later than 14 working days (subject to availability of the replacement).

2. PURCHASE METHODS

2.1. The Customer can only purchase the products present in the online catalog of the website www.axor.net at the time of placing the order, as described in the relevant technical and information sheets, except for manufacturer’s improvements. It is understood that the image attached to the product description sheet may not be perfectly identical in some of its features but may differ in color, size, accessory products shown in the figure, or simply represent the product series or family. All information supporting the purchase (Glossary, Guides, etc.) is to be considered as simple general information material, not referable to the actual characteristics of a single product. The price indicated in the product sheets includes VAT, at the rate in force in the Italian territory.

2.2. Order receipt is confirmed by AXOR S.R.L. via e-mail, sent to the e-mail address indicated by the Customer. This confirmation message will show the order Date and Time and a Number, to be used in any communication with AXOR S.R.L. The message shows the data entered by the Customer, who undertakes to verify its correctness and promptly communicate any corrections, using 1 any suitable means.

3. PAYMENT METHODS

3.1 – Credit card, debit card, prepaid card: in case of purchase of products with “Credit Card” payment, the charge will be made upon order confirmation.

3.2 – AXOR S.R.L. reserves the right to request additional information from the Customer (e.g., landline telephone number) or to send a copy of documents proving ownership of the Card used. In the absence of the requested documentation, AXOR S.R.L. reserves the right not to accept the order.

3.3 – During and after the purchase procedure, AXOR S.R.L. is able to know information relating to the buyer’s credit card, transmitted through protected connections directly to the bank that manages the transaction. AXOR S.R.L. can keep this information only in case of explicit request and consent of the customer: AXOR S.R.L. guarantees that these are stored according to certified security standards and that they are always displayed in masked mode.

3.4 – Cash on delivery: in case of purchase with cash on delivery payment, a supplementary contribution will be applied to the total amount to cover the courier’s management costs, clearly highlighted when choosing the payment method. Payment, to be made directly to the courier, will take place upon delivery of the products. Payment can only be made in cash; the courier will not deliver in case of payment by check.

3.5 – Advance bank transfer: the advance bank transfer payment method provides that the order is processed and fulfilled only after the credit to the indicated bank account of AXOR S.R.L. The necessary data are displayed on the website and are in any case communicated at the time of order confirmation and in the e-mail sent to the Customer. The reason for the bank transfer must necessarily include the order number, the name and surname of the order holder.

3.6 – Payments via PayPal Account: in case of purchase of goods with payments via PayPal, upon completion of the online transaction, PayPal will immediately charge the amount related to the purchase made.

3.7 – During and after the purchase procedure, AXOR S.R.L. is able to know information relating to the customer’s PayPal account, transmitted through protected connections directly to the bank that manages the transaction. AXOR S.R.L. can keep this information only in case of explicit request and consent of the customer: AXOR S.R.L. guarantees that these are stored according to certified security standards and that they are always displayed in masked mode.

4. DELIVERY METHODS AND COSTS

4.1. AXOR S.R.L. can accept orders only with delivery in Italy and the European Community, San Marino, and Vatican City. For remote locations, minor islands, Livigno, and Campione d’Italia, surcharges are provided, which will be expressly indicated before payment of the order.

4.2. Sales made on www.axor.net are similar to mail order sales and therefore without invoice obligation as provided for in Article 22 of Presidential Decree no. 633 of 1972, and without fiscal receipt obligation as provided for in Article 2, letter oo), of Presidential Decree 21 December 1996, no. 696. The tax invoice must be expressly requested before or at the same time as the order is completed.

4.3. Delivery costs, where present, are charged to the Customer and are specified separately when placing the order. Nothing more is due from the Customer than the total order amount.

4.4. No responsibility can be attributed to AXOR S.R.L. in case of delay in processing the order or in delivery by the carrier.

4.5. The delivery of the order is intended at street level unless:
– otherwise communicated to our customer service;
– as provided in the specifications and technical sheet of the product.
Upon delivery of the purchased products, the Customer is required to check:
– that the number of packages corresponds to what is indicated in the order confirmation and in any subsequent communication;
– that the packaging is intact, undamaged, not wet or otherwise altered, especially in the closing materials (adhesive tape or straps).
Any damage to the packaging, the product, or the mismatch of the number of packages or any indications must be immediately contested, by writing “CONDITIONAL INSPECTION RECEIPT” (carefully specifying the reason for the reservation, e.g., “holed packaging”, “crushed packaging”, “open package”) on the courier’s delivery slip. Once the delivery document is signed, no further dispute regarding the external characteristics of what has been delivered will be possible.
Any problems concerning the physical integrity, correspondence, completeness, and correctness of the products received must be reported within 3 days of delivery, according to the methods provided in this document.

4.6. In case of failure to collect the purchased products in storage at the courier’s warehouses within 5 working days due to repeated impossibility of delivery to the address indicated in the payment form by the Customer at the time of the order, the ordered goods will be returned to the warehouses of AXOR S.R.L.

4.7. In case of return of one or more purchased products, the delivery methods from the customer to AXOR S.R.L. differ depending on the product category for which the customer expresses the wish to exercise their right of withdrawal within and no later than 14 days from the delivery date, for which the delivery proof kept by the carrier in charge of the final delivery will be valid.

5. RIGHT OF WITHDRAWAL

5.1. Pursuant to Articles 64 et seq. of Legislative Decree 206/05, if the customer is a consumer (i.e., a natural person who makes purchases for purposes not related to their professional activity), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

5.2. To exercise this right, the customer must, within 14 working days from the date of receipt of the products, contact AXOR customer service at 0429 763476, or send an email to [email protected], or send a communication by registered letter with return receipt, specifying that they wish to exercise the right of withdrawal to:

Once the product has been returned according to the methods explained in point 4.7, AXOR S.R.L. will, within 30 days of the return of the goods (a period during which the integrity and functionality of the product and packaging will be checked), credit the amount back after verifying the integrity of the goods. The credit will be made to the respective credit card, debit card, prepaid card, or PayPal account.

The goods must be returned intact and functional, complete with all their components and in the original and undamaged packaging (bags and boxes), stored and possibly used with normal diligence, in total absence of wear or dirt.

5.3. The right of withdrawal is subject to these conditions:
– it applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on a fraction of the purchased product;
– the purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any accessory documentation); in any case, the application of labels or adhesive tapes directly on the original packaging of the product is to be avoided;
– the shipping and integrity of the product, until receipt in our warehouse, is under the full responsibility of the Customer;
– upon arrival at the warehouse, the product will be examined to assess damage, tampering, and missing parts of the same not resulting from transport. If the packaging and/or packaging are damaged, AXOR S.R.L. may withhold from the refund due a percentage, within and no more than 10% of the same, as a contribution to the restoration costs.

5.4. The right of withdrawal is entirely forfeited, due to the lack of the essential condition of integrity of the goods, in cases where AXOR S.R.L. ascertains:
– unconventional use of the goods that caused wear and damage to the goods, or the use of any consumables;
– the lack of the outer packaging, the original inner packaging or part of it;
– the absence of integral elements originally attached to the product;
– damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, the goods will be made available to the Customer for collection at their expense at the AXOR S.R.L. headquarters.

6. COMMUNICATIONS AND PROCESSING OF PERSONAL DATA

With the entry into force of Legislative Decree 196/03, containing provisions for the protection of individuals and other subjects with respect to the processing of personal data, the staff of AXOR S.R.L., as Data Controller, is required to provide some information regarding the use of personal data.

6.1. By accepting the General Conditions of Sale, the processing of personal data in accordance with current legislation is also considered signed and accepted.

6.2. Data processing will take place using tools suitable to ensure security and confidentiality, and the data will be processed mainly with computer tools and stored both on computer media and on paper media and on any other suitable type of media. We also inform you that personal data will be processed in compliance with the methods indicated in Legislative Decree 196/2003, which provides, among other things, that the data themselves are:
– processed lawfully and fairly;
– collected and recorded for specific, explicit, and legitimate purposes;
– accurate and, if necessary, updated;
– relevant, complete, and not excessive with respect to the formalities of the processing.

6.3. Data regarding domicile, telephone number, email address, and any additional information will be communicated to the courier chosen for shipping to facilitate delivery. If the buyer does not wish to share their telephone number, they must communicate this by email before the preparation of the shipment.

The data processing is carried out by the possible manager and by the persons in charge previously appointed according to articles 29 and 30, who operate under the control and responsibility of the Data Controller.

7. PROMOTIONS AND DISCOUNTS

Promotions and discount vouchers present on www.axor.net are not cumulative unless otherwise indicated.
