1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1.1. The contract stipulated between AXOR SRL and the Customer is to be considered concluded with the acceptance, partial or entire, of the order by AXOR SRL. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read and accepted all the information provided to him in the various stages of the purchase, and to fully accept the general and payment conditions.

1.2. If the Customer is a private consumer (i.e. a natural person who purchases the goods for purposes not attributable to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of the articles. 50 and following of Legislative Decree 206/05.

1.3. Any right of the Customer to compensation for damage or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or things, caused by total or partial non-acceptance of an order and for any improper use of the purchased products. All products sold by AXOR SRL are CE marked, therefore before use it is the consumer's obligation to read all the safety measures indicated by the company.

1.4. AXOR SRL reserves the right to cancel an order, upon refund of the amount paid by the buyer, due to lack of availability of the material or for other reasons even in stages subsequent to payment. Furthermore, any request for compensation for the unavailability of the products is excluded. The buyer will be entitled to a refund of the total amount paid or will be able to claim a credit of the same amount for the choice of alternative products.

1.5. AXOR SRL is in possession of all the products for which immediate availability is expressly indicated. All other products, for which the days needed to ship are estimated, are ordered from the respective suppliers at the time of acceptance of the order. The customer acknowledges that the expected shipping date is purely indicative and does not constitute a basis for the relationship with the customer and third parties, therefore AXOR SRL is not liable for delays caused by the lack of availability on the part of the supplier or for any delay not directly attributable to AXOR SRL. If due to force majeure it is not possible to complete the order even after the times indicated, at the customer's request AXOR SRL will immediately refund the payment and cancel the order. In case of payment by bank transfer, the customer undertakes upon request of AXOR SRL to provide the data necessary to carry out the payment reversal transfer.

1.6. AXOR SRL is not liable for damages caused during transport by the carrier, who is solely responsible for the goods transported. Any request for replacement, return or cancellation for this type of damage can only be forwarded if at the time of delivery any damage to the packaging has been notified to the courier via the "signature with reserve". Any replacement of the product will be carried out only after all checks have been carried out upon return of the defective product, no later than 14 working days (subject to availability of the replacement).

2. PURCHASE METHODS

2.1. The Customer can only purchase the products present in the site's online catalogue www.axor.net at the time of placing the order, as described in the relevant technical and information sheets, except for improvements made by the manufacturer. It is common ground that the image attached to the descriptive sheet of a product may not be perfectly identical in some of its characteristics but may differ in colour, size, accessory products present in the figure or simply represent the series or family of the product. All information supporting the purchase (Glossary, Guides, etc.) is to be understood as simple generic information material, not referable to the real characteristics of a single product. The price indicated in the product data sheets includes VAT, at the rate in force in Italy.

2.2. Receipt of the order is confirmed by AXOR SRL via email response, sent to the email address indicated by the Customer. This confirmation message will contain the date and time of the order and a number, to be used in any communication with AXOR SRL. The message contains the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, using any suitable means.

2.3. In case of non-acceptance of the order, AXOR SRL will promptly notify the Customer.

3. TERMS OF PAYMENT

3.1 – Credit card, debit card, prepaid card: in case of purchase of products with "Credit Card" payment method, the charge will be made upon confirmation of the order.

3.2 – AXOR SRL reserves the right to request from the Customer additional information (e.g. landline telephone number) or to send a copy of documents proving ownership of the Card used. In the absence of the required documentation, AXOR SRL reserves the right not to accept the order.

3.3 – During and subsequently the purchase procedure AXOR SRL is able to become aware of information relating to the buyer's credit card, transmitted through protected connections directly to the banking institution that manages the transaction. AXOR SRL can store this information only in the case of explicit request and consent of the customer: AXOR SRL guarantees that this is stored according to certified security standards and that it is always displayed in masked mode.

3.4 – Cash on delivery: in the case of purchases with cash on delivery, an additional contribution will be applied to the total amount towards the courier management costs, clearly highlighted when choosing the payment method. Payment, to be made directly to the courier, will take place upon delivery of the products. It is possible to pay exclusively in cash, the courier will not deliver in case of payment by cheque.

3.5 – Advance bank transfer: the payment method by means of advance bank transfer requires that the order is processed and processed only after it has been credited to the indicated current account of AXOR SRL. The necessary data is displayed on the site and in any case is communicated indicated at the time of order confirmation and in the e-mail sent to the Customer. The reason for the bank transfer must necessarily include the order number, name and surname of the order holder.

3.6 – Payments via PayPal account: in cases of purchase of goods with payments via PayPal, upon conclusion of the online transaction, PayPal itself will immediately debit the amount relating to the purchase made.

3.7 – During and subsequently the purchase procedure AXOR SRL is able to become aware of information relating to the customer's PayPal account, transmitted through protected connections directly to the banking institution that manages the transaction. AXOR SRL can keep this information only in case of explicit request and consent of the customer: AXOR SRL guarantees that this is stored according to certified security standards and that it is always displayed in masked mode

4. DELIVERY METHODS AND COSTS

4.1. AXOR SRL can only accept orders for delivery in Italian territory and the European community, San Marino and Vatican City. For disadvantaged locations, smaller islands, Livigno and Campione d'Italia, surcharges are foreseen which will be expressly indicated before payment of the order.

4.2. Sales made on www.axor.net are similar and can be traced back to mail order sales and therefore without the obligation of an invoice as provided for in Article 22 of Presidential Decree 633 of 1972, and without the obligation to issue a receipt as provided for in Article 2, letter oo), of Presidential Decree 21 December 1996 , n. 696. The tax invoice must be expressly requested before or at the same time as completing the order.

4.3. Delivery costs, if any, are borne by the Customer and are specified separately when placing the order. Nothing more is owed by the Customer than the order total.

4.4. No responsibility can be attributed to AXOR SRL in the event of a delay in processing the order or in delivery by the carrier.

4.5. Delivery of the order is intended to be at street level except:
– different communication to our customer service;
– as provided in the specifications and technical data sheet of the product.
Upon delivery of the purchased products, the Customer is obliged to check:
– that the number of packages corresponds to what is indicated in the order confirmation and in any other subsequent communication;
– that the packaging is intact, not damaged, not wet or in any case not altered, also and above all in the closing materials (adhesive tape or straps).
Any damage to the packaging, to the product or the mismatch in the number of packages or any indications must be immediately reported, by adding the wording WRITTEN CONTROL RESERVE (carefully specifying the reason for the reserve, e.g. "punctured packaging", "packaging crushed”, “open package”) on the courier's delivery slip. Once the delivery document has been signed, it will no longer be possible to raise any objections regarding the external characteristics of what was delivered.
Any problems relating to the physical integrity, correspondence, completeness and correctness of the products received must be reported within 3 days of delivery, according to the methods set out in this document.

4.6. In the event of failure to collect the products purchased in stock at the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated in the payment form by the Customer at the time of the order, the ordered items will be returned to the AXOR SRL warehouses.

4.7. In case of return of one or more purchased products, the delivery methods by the customer to AXOR SRL differ depending on the product category of the product or products for which the customer expresses the desire to exercise his right to withdraw no later than 14 days from the delivery date, for which proof of delivery kept by the carrier responsible for final delivery will be valid.

5. RIGHT OF WITHDRAWAL

5.1. Pursuant to the articles. 64 and following of Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who makes purchases for purposes not attributable to his professional activity), he has the right to withdraw from the purchase contract for any reason, without the need for provide explanations and without any penalty.

5.2. To exercise this right, the customer must, within 14 working days from the date of receipt of the products, contact AXOR customer service on 0429 763476, or send an email to the email address [email protected], or send a communication by registered letter with return receipt, specifying that you wish to exercise the right of withdrawal to:

Once the product has been returned according to the methods explained in point 4.7, AXOR SRL will refund the amount within 30 days of the return of the goods (period within which the integrity and functionality of the product and packaging will be checked). the amount after verifying the integrity of the goods. The refund will be made to the respective credit card, debit card, prepaid card or PayPal account.

The goods must be returned intact and functional, complete with all their components and in the original and undamaged packaging (envelopes and packages), kept and possibly used according to normal diligence, in the total absence of wear or dirt.

5.3. The right of withdrawal is subject to these conditions:
– applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on a fraction of the product purchased;
– the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any additional documentation); in any case, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided;
– the shipment and integrity of the product, until receipt in our warehouse, is under the complete responsibility of the Customer;
– upon arrival in the warehouse, the product will be examined to assess damage, tampering and missing parts not resulting from transport. If the package and/or packaging are damaged, AXOR SRL may withhold a percentage from the refund due, no more than 10% of the same, as a contribution to the costs of restoration.

5.4. The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods, in cases where AXOR SRL ascertains:
– the unconventional use of the goods which has caused the wear and tear of the goods, or the use of any consumables;
– the lack of the external packaging, the original internal packaging or part of it;
– the absence of integral elements originally attached to the product;
- damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, the goods will be made available to the Customer for collection at his expense at the headquarters of AXOR SRL.

6. COMMUNICATIONS AND PROCESSING OF PERSONAL DATA

With the entry into force of Legislative Decree 196/03, containing provisions for the protection of persons and other subjects with respect to the processing of personal data, the staff of AXOR SRL, as Data Controller, is required to provide some information regarding the use of personal data.

6.1. By accepting the General Conditions of Sale, the processing of personal data in accordance with current legislation is deemed to have been signed and accepted.

6.2. The data will be processed using suitable tools to guarantee security and confidentiality and the data will be processed mainly with IT tools and stored both on IT media and on paper media and on any other type of suitable media. We also inform you that personal data will be processed in compliance with the methods indicated in Legislative Decree 196/2003, which provides, among other things, that the data itself is:

– processed lawfully and fairly;
– collected and recorded for specific, explicit and legitimate purposes;
– accurate and, if necessary, updated;
– relevant, complete and not excessive with respect to the formalities of the processing.

6.3. The data regarding the domicile, telephone number, email address and any additional information will be communicated to the courier chosen for the shipment to facilitate delivery. If the buyer does not wish to share his telephone number, he must communicate it via email before preparing the shipment.

The data processing is carried out by the person responsible and by the persons in charge previously appointed on the basis of the articles. 29 and 30, which operate under the control and responsibility of the Owner.

The promotions and discount coupons available on www.axor.net they cannot be combined with each other unless otherwise indicated.
